›Person‹ ist ein Leit- und Schlüsselbegriff der abendländischen theoretischen und moralisch-praktischen Philosophie sowie der Rechtslehre, der im Laufe der Philosophiegeschichte methodisch je verschieden erschlossen wurde, u. a. rhetorisch durch Sprecherrollen, substanzontologisch, transzendentalphilosophisch, phänomenologisch oder empiristisch. Traditionell wurde der philosophische Personbegriff auf Vernunftwesen bezogen, theologisch außer auf den Menschen auch auf göttliche Personen oder Engel. Im Recht kennzeichnet die natürliche Person den Status der mit Personrechten ausgestatteten Rechtsperson und erweist sich somit seit Mitte des 20. Jahrhunderts als ein begründungstheoretisches Äquivalent zum (...) völker- und verfassungsrechtlichen Begriff der Menschenwürde. Seit dem römischen Recht besteht zudem der in der Rechtsdogmatik bis heute wirkmächtige Dualismus von Person und Sache, der Personen dadurch definiert, dass sie Eigentumsansprüche auf ›Sachen‹ erheben können und insofern Personen- von Sachenrecht trennt. It is widely acknowledged that some truths or facts don’t have a minimal full ground [see e.g. Fine ]. Every full ground of them contains a smaller full ground. In this paper I’ll propose a minimality constraint on immediate grounding and I’ll show that it doesn’t fall prey to the arguments that tell against an unqualified minimality constraint. Furthermore, the assumption that all cases of grounding can be understood in terms of immediate grounding will be defended. This assumption guarantees that (...) the proposed minimality constraint is significant for all cases of grounding. With its help one can get a clear grip on the relevance of grounding, a feature that will be put to use in the penultimate section. (shrink)

Zusammenfassung Die Gewaltforschung nimmt seit ca. 20 Jahren auch in der Alten Geschichte einen ihr gebührenden Platz ein. Dabei kann mittlerweile mit digitalen Methoden auf die ‚big data‘ der antiken Quellen (Literatur, Inschriften, Münzen, Papyri) zugegriffen werden. An der Universität Hamburg entsteht derzeit das Informationssystem ERIS: Hamburg Information System on the Representation of Greek and Roman Violence, das alle Erwähnungen bzw. Beschreibungen von Gewalt in der antiken Historiographie und Biographie mit soziologischen Parametern annotiert und somit ein großes Quellencorpus auf elektronischem (...) Wege thematisch suchbar macht. Die folgende Machbarkeitsstudie, auch Methodensicherungsinstrument genannt (‚proof of concept/principle‘), wird anhand des Vergleichs dreier Plutarch-Viten die Leistungsfähigkeit des Systems erweisen: Die Bestätigung bekannter Sachverhalte mit einer neuen Methode lässt hoffen, dass das System auch bei der Suche in größeren Datenbeständen, die nicht mehr durch die Leseleistung eines Individuums erschlossen werden können, zu sinnhaften und validen Ergebnissen führt. Im Folgenden wird dargelegt, wie ERIS Fragestellungen der Gewaltsoziologie sowie der Alten Geschichte aufgreift und mit den Potentialen der Digital Humanities verknüpft und weiterführt. (shrink)

The following translation is a reduced and revised version of the paper Schicksal Nietzsche? Zu Nietzsches Selbsteinschätzung als Schicksal der Philosophie und der Menschheit " - originally published in Nietzsche-Studien 37 - which was specially prepared to be presented in lecture organized by the Grupo de Pesquisa Spinoza & Nietzsche, in the Universidade Federal do Rio de Janeiro, on September 14, 2009. In the text, the autor employs his own philological-hermeneutical methodology, which is called contextual interpretation, in the purpose to (...) clarify the concepts of the first aphorism from "Why I am a destiny", from Ecce Homo, in its own context, in the context of Ecce Homo and in the context of the entire work from Nietzsche. Temporal loops in which two agents are involved in a circle of reactive attitudes create a puzzle concerning who harms whom. I argue that this puzzle, which has been developed by Stephen Kearns in a recent paper in this journal, should be solved by accepting that the situation involves normative indeterminacy. A supervaluationist treatment of this indeterminacy allows us to maintain that the normative supervenes on the non-normative and that the involved agents are in normatively symmetric situations. It further allows (...) to maintain that it is determinately the case that one agent wrongs the other just in case the latter does not wrong the former. I conclude by tentatively arguing that the indeterminacy involved should not be understood as semantic and that the puzzle provides us with a novel case of indeterminacy in reality. (shrink)

This review article deals with legal texts prominently inscribed on a city gate of Timnaʿ, the capital of the Ancient South Arabian state of Qataban. Following a sketch of the history of the region and its languages, the reviewer considers the legal texts published in the reviewed volume dealing with homicide, the attribution of tithes, infanticide, and other matters. It is pointed out that their interpretation by the author would have benefited from comparisons with Yemeni anthropological data that have not (...) changed since pre-Islamic times. (shrink)

Este artículo se refiere a la doctrina práctica de Aquino sobre dos dificultades filosóficas que subyacen en gran parte del debate ético contemporáneo. Una es la Is-ought thesis de Hume y la otra es su consecuencia radical la Open-question argument de Moore. Estas paradojas éticas parecen tener sus raíces en un scepticismo epistemológico y en una antropología deficiente. La posible respuesta a ellas se puede encontrar en que: a) Tomás de Aquino defiende la esencial racionalidad y unidad del ser humano; (...) b) La ley natural tomista es una consecuencia natural del ser racional; c) La razón humana es esencialmente teórica y práctica al mismotiempo. El intelecto humano de Aquino naturalmente realiza tres operaciones principales: 1º) Aprehender las nociones inteligidas y universales ens, verum y bonum. 2º) Formular los primeros principios teóricos y prácticos. 3º) Ordenar que se haga el bien inteligido y universal y se evite lo contrario. Por estas razones,la respuesta filosófica de Aquino a ambas dificultades no es exclusivamente ética, sino que abarca armónicamente la ontología, antropología y epistemología. La ética de Tomás de Aquino es fundamentalmente diferente de las éticas que califican las acciones como buenas o por mero consenso social (contractualismo) o simplemente calculando sus consecuencias (consecuencialismo). The article addresses the following question: if an extensive period of globalization and also democratization after the fall of the Berlin Wall has been followed by populism, does this mean that there is something wrong with liberalism itself? Must liberalism be substituted by alternative economic and political concepts? The article presents three alternatives to liberalism that are supposed to counter populism: a new communitarianism, a renewal of the democratic project as much as novel conceptions of social justice. However, it takes (...) also into account positions that address the current crisis from within the liberal framework itself. (shrink)

Both nihilism and universalism are historical products of Western speculative philosophy. The failure of this philosophy to discover universally valid laws resulted in widespread despair, which at times created a suicidal atmosphere. The other worldly promises offered by dualistic world models made an escape into an alternate world attractive. This paper investigates whether Nietzsche’s proposal to rekindle the fire of life by recovering the Dionysian spirit in creative work is a feasible alternative to nihilistic despair. It goes on to investigate (...) whether a new sense of community and collaborative ethics can be distilled from a renewed engagement with nature. Recent scientific discoveries and experiential evidence could lead to a reformulation of virtue ethics based on naturalistic sources. (shrink)

By now scholars agree that the foundation of the University of Berlin in 1810 and its glorification through the “Humboldtian myth” must be viewed separately. Nevertheless, ever since the 1910 centennial, historiography has rarely gone beyond references to the historical documents edited by Rudolf Köpke and Max Lenz. Analyzing the lectures announced in the university calendar for the fall semester 1810/11, the essay shows that applied science and vocational training played a larger role than assumed. In founding the university, it (...) seems, the authorities looked rather for the advancement of the common public interest than for the realization of a “Bildungsideal”. This essay pleads, therefore, for a comprehensive reassessment of the historical documents from the planning and founding stages of the University of Berlin. (shrink)

Von theologischer wir philosophischer Seite wird bisweilen gefordert, Vergebung müsse unbedingt sein. Darüber hinaus wird bei Psychotherapeuten die therapeutische Wirkung der Vergebung betont, so dass Vergebung im Eigeninteresse der gekränkten oder geschädigten Personen zu liegen scheint. Dabei werden Gesichtspunkte der Gerechtigkeit und der Prävention und der Selbstachtung des Opfers übersehen, wie die im Artikel aufgezeigten Vorbehalte deutlich machen können. Dabei kommt speziell die Perspektive der Geschädigten, der Opfer stärker in den Blick. Außerdem sind die einschlägigen Mahnungen im Neuen Testament, die (...) die Unbedingtheit der Forderung nach Vergebung zu bestätigen scheinen, bei genauer Betrachtung durchaus differenzierter. Available here for the first time in English, "Reality and Its Order" is a remarkable philosophical text by Werner Heisenberg, the father of quantum mechanics and one of the leading scientists of the 20th century. Written during the wartime years and initially distributed only to his family and trusted friends, the essay describes Heisenberg’s philosophical view of how we understand the natural world and our role within it. In this volume, the essay is introduced by the physicist Helmut Rechenberg (...) and annotated by the science historian Ernst Peter Fischer. The content, particularly within its historical context, will be of great interest to many physicists, philosophers and historians of science. (shrink)

The European Union’s history has an unique character: it has achieved the creation of unity without cancelling the singularities that uphold it; it has the capability of action without depriving its member states of their functions. Carl Schmitt is hereby confuted: sovereignty can be divided. Europe thus appears as a laboratory for international political history. In more than two millennia Europeans have carried out experiments with themselves developing a self-understanding as representatives of humanity. Now they can again understand themselves as (...) an example that they show to themselves, such as each one should be, in his own person, an example for humanity. He who becomes a model for others cannot obtain pretences from it. He can only be satisfied in establishing that he is understood. (shrink)

This article—mainly referring to the situation in Germany—consists of three parts. In a first section the current presence of neurosciences in the public discourse will be described in order to illuminate the background which is relevant for contemporary educational thinking. The prefix ‘neuro-’ is ubiquitous today and therefore concepts like ‘neuropedagogy’ or ‘neurodidactics’ seem to be in the mainstream of modern thinking. In the second part of the article the perspective changes from the public discourse to the disciplinary discourse; a (...) brief excursus into developmental psychiatry, neuropsychology and modern psychoanalysis will be made in order to demonstrate how the results of neuroscientific research are integrated in their theoretical frameworks. These three disciplines have no difficulty in integrating neuroscientific findings because each of them possesses a systematic core composed of ‘native concepts’. In contrast to them, educational theory has much more difficulty with such integration, as will be shown in the third part of the essay. On the one hand, neuroscientific thinking seems to be able to dominate education rather easily and without great resistance, especially in the fields of early childhood education, instruction and learning—mainly by simplifying educational processes and by reducing the complexity of the educational task to a mere ‘relationship problem’. On the other hand, this attraction of neuroscience in education might be understood as the reflection of a theoretical deficit in educational theory itself, with the significance of affect and emotion not receiving proper attention.
